‘Smoking Amendment Survey Results and Call for Responses’

To date, we have received 45 responses to our Smoking Amendment Survey. Of those responses 73% would support an amendment that includes prohibiting smoking in any area of the condo including units.  60% of those in favor would support grandfathering current owners to some limited exenption.  No respondents were smokers.

The Smoking Amendment Survey was distributed to all unit owners on 6/22/16 and 9/21/16 by Royal Management via mail.  If you haven’t already, please complete the survey  and leave the form in the office, send it by mail P.O. Box 850, Methuen, MA 01844, or email it to Cathy royal.cathy@comcast.net.   We would really like to see how all owners feel before we decide on pursuing this amendment.

  1. Here’s the thing.

    Marijuana is going to be completely legal in MA in 2 weeks (vs practically legal now) and sold in stores in 2018. But it’s only going to be legal to smoke in your own home, not outside. If this proposed amendment passes, people who want to smoke pot legally, can’t, and forced to choose between breaking the law and annoying their neighbors they’re going to smoke in their apartments. You can’t just ban a behavior like that and expect quiet compliance.

    All pursuing this will do is make us suspicious of each other and angry at each other for (depending on your perspective) either not following, or instituting, contradictory and conflicting rules.

    1. This seems to be a legal matter. Passing a non smoking policy stands in the face of the law. Is it legal to ban smoking marijuana in a condo unit?

  2. I am not a smoker, nor is my partner. I believe this amendment broaches on an invasion of privacy and individual liberty. How would this be enforced? Are we saying we are giving the association permission to search our private residences? Given the shared ventilation, how will one know which unit is the culprit?

    Apart from these concerns, what does this mean for resale of units? I can imagine it restricts pool of potential buyers.

    I would much rather explore options for filters in our units that would prevent smoke from entering our units.
